Tenant Eviction Update

Practice Direction 55C was made in July 2020 and makes temporary amendments to procedure in possession claims under CPR 55.

In short, for cases which had been issued before 3 August 2020 and which had been subject to the automatic stays imposed by PD51Z or CPR 55.29, there is a requirement for a “reactivation notice” confirming that one or both of the parties wishes the claim to proceed. For cases issued on or after 3 August 2020, there are additional requirements imposed on claimants to provide the court with details of the impact of the pandemic on the tenant.

The Practice Direction was due to expire on 31 March 2021. On 29 January 2021, it was extended so that it now expires on 30 July 2021.
